Shipping address - All correspondence, returns, exchanges of goods and complaints should be addressed directly to: Ars Tattoo, ul. Styrska 20A, 04-188 Warszawa.
Products - Products offered on the store's website Ars Tattoo. All products names’ and trademarks’ are the sole property of their respective manufacturers and are subjected to legal protection. Regarding current law we inform the owner of the store is an importer (introduction to trading on the territory of Poland) the products’ parts that are sold. Offer and prices of products are valid while stocks last. Prices of products are administered in PLN and include all applicable duties and taxes. The site offers basic information about the properties of the products, its price, the materials from which they are made, composition, etc. Product photos possibly faithfully reflect their actual appearance. However, we underline the colors may slightly differ, this is due to different parameter settings that can be displayed by clients’ monitors.
Price - Prices of products are administered in PLN gross and include all applicable duties and taxes - Product prices do not include the price of shipping. Offer and prices of products are valid while stocks last. Ars Tattoo Shop reserves the right to make changes in product prices, carry out and remove all kinds of promotion and sales in accordance with applicable regulations. The change in prices of products may not occur after the order by the customer.
Delivery costs - the price of the product does not include shipping cost. Delivery costs depend on the service provider, in this case the courier company UPS and the Polish Post. It also depends on the choice of payment method. Within a single contract the price of the shipping is counted only once.
Product photos - photos of most of the products are made by the owner of the shop Ars Tattoo and are marked with a water sign, company logo Ars Tattoo. Product photos possible faithfully reflect their actual appearance. However, we reserve the colors may differ slightly, this is due to different parameter settings displayed by the clients’ monitors. We do not make additional product images on request. Any use of images, copying in whole or in part without written permission of the owner of the store is strongly prohibited.
Product Availability - All the products offered in the store Ars Tattoo are available, unless the product description is described differently. In exceptional situations, such as simultaneous purchase by several customers for the same product or other technical error store can prove that the product will not be available. In this case, the shop immediately contacts the customer informing about the situation.
Order - Customers can order products 24 hours a day through an online store, sending an email to firstname.lastname@example.org or telephone number +48 (22) 509 69 80 and +48 609 322 161, in the work shop. E-mail should include customer’s name, address, contact telephone number, the exact name of the product, form of payment and shipping. Placing orders is equal to signing the sales contract between the owner of the shop, and the Client. If the store cannot process the order, then immediately notify the customer of the situation.
Order Status - Uniquely identifies the status of the contract. In some cases of changing the status of the order this information is sent to the customer in additional e-mail confirmation. Preview of Status order is also possible for registered customers after logging on www.arstattoo.pl
Below can be found a list and brief description of the possible status options contracts:
Accepted - order was properly taken and is waiting for realization.
In progress - Contract is being packed and waits to be processed by your transfer.
Sent - The order has been sent.
Cancelled - The order was canceled prior to shipment.
Inbox - Orders was delivered by the store Ars Tattoo.
Delivered - Order has reached the transport Ars Tattoo Shop.
I expect to receive - Order has been completed and is looking forward to be collected in the Ars Tattoo store.
Shipping orders - Ordered products are shipped via UPS courier or the Polish Post, depending on the choice of the customer. Shipping orders COD is realized only in Poland. Shipping orders prepaid account is done in Poland and abroad.
Shipment - The completed and packed order with the labeled address is transferred to Courier. Shipments are well packed (bubble envelopes, cartons) and insured. Shipment status can be monitored on the courier UPS website. Information on the status of the shippment will be visible from the moment of delivering the package to the store courier company, about the evening on the day of posting. When the courier will deliver the customer the damaged shipment it should be refused to take or be opened in the presence of a representative of the carrier. In case of absence, please write a protocol state of material goods, and please contact the store by Ars Tattoo. Shop regardless of the procedure ongoing at the Courier would literally replace missing product. The customer is required to open and inspect the material into and its contents after receiving.
Cancellation of the order - The customer has the right to cancel the order for the dispatch of the product. You should then send an email or call email@example.com in the work shop.
Payment - The contract customer can pay cash by the delivery (only in case of shipping within Poland) - that is, at the moment of delivery the order by courier to the indicated address, or make a payment. Prepayment can be done using conventional bank transfer, transfer or credit card. Full security of transactions is guaranteed by a specialized online payments company Dotpay.pl. We do not consider confirmations made by the private transfer.
DHL, UPS - The completed orders are shipped via UPS courier. At this moment we provide tracking number only on request. The shipment can be monitored via the courier company UPS. Courier packages are well packed (bubble envelopes, cartons) and insured.
Polish Post - At this moment tracking number is provided only on request. The shipment can be tracked on the Polish Post. Postal shipments are well packed (bubble envelopes, cartons) and insured.
Working days - all days of the week from Monday to Friday, excluding public holidays.
Delivery time - the time in which the shop Ars Tattoo completes the order and send to the address provided by the customer. Standard delivery time is from 1 (UPS) to 2 (Polish Post) working days, unless the customer will be informed by us earlier to extend the implementation. In the case of an order until 13:00 of the current day, the order will be processed the same day. In selecting the method of payment traditional transfer, the contract only after the payment is on our account. We did not consider confirmation of the transfer.
Condition of the contract is to provide correct personal data in the phone number.
Delivery time (Business Courier UPS) - Time, in which the courier receives delivery from the store Ars Tattoo to the address specified by the customer. The standard delivery time for a courier company UPS is 1 working day (in Polish). The requirement is to provide the correct personal data and the phone number. Order accompanied by proof of purchase (receipt or invoice).
Delivery time (Polish Post) - The time in which the Polish Post delivers the shipment to the Polish Post office provided to the address given by the customer. The requirement of the contract is to provide correct personal data in the phone number. Order accompanied by proof of purchase (receipt or invoice).
Proof of purchase - Proof of purchase is a receipt or invoice that the customer receives by the shipping, together with the products. Proof of purchase entitles you to a warranty.
Warranty - Products and services are covered by 12 months warranty. Detailed terms of the guarantee are specified in the contract issued by the guarantor. Merchandise with a guarantee of service Ars Tattoo should be sent at his own expense by the Polish Post at the address: Ars Tattoo, ul. Styrska 20A, 04-188 Warsaw. The repaired product is sent to the customer on expense of the seller.
Exchange - (applies to Consumer) If the resulting product for some reason does not meet customer’s expectations, it can be returned it within 14 days of receipt. We ask that the product is returned in the same state (unused). For packages, please attach FORM OF EXCHANGE and proof of purchase. Product packaging can be replaced, but should protect the product from damage during shipment in the same way as the original packaging. Within 5 working days from receiving the exchange money would be given to the bank account. We do not accept COD parcels. In the meantime, the consumer can order a replacement product in the store Ars Tattoo. The cost of re-shipment shall be paid by the customer.
Reimbursement - (applies to Consumer) If the resulting product for some reason does not meet client’s expectations, it can be returned within 14 days. Please be advised that we do not accept returns sent "cash on delivery". For packages, please attach a statement of withdrawal - the returns form and proof of purchase. We ask that the product is returned in the same state (unused).
Product package can be replaced, but should protect the product from damage during shipment in the same way as the original package. The form of resignation should be filled out and sent as the letter to the following address: Ars Tattoo, ul. Styrska 20A, 04-188 Warszawa, or e-mail: firstname.lastname@example.org to resign the contract by an unequivocal statement. To do this, you can use the resignation form, which is attached to the Regulation. Please keep the deadline for resignation, it is crucial to send consumer information concerning the right of contract cancellation before the deadline for resignation. In the case of resignation we return all payments received, including the costs of delivery of the Product to Consumer (with the exception of the additional costs resulting from the choice of a type of delivery other than the least expensive normal delivery offered by us), no later than 14 days from the day on which we are informed about the decision of resignation, the refund payment does not occur until receiving of the product, or the evidence that consumer has supplied. The consumer pays the direct cost of returning items. Reimbursement of payments will be done using the same payment methods that were used in the original transaction, unless the consumer agrees otherwise. Detailed consumer rights established by law. Based on Article. 38 of the Act of 30 April 2014 on consumer rights (Dz. U. of 2014., Pos. 827), the right to resign from a distance contract is not entitled to a customer in particular with regard to contracts:
1) the provision of services if the trader made a full service with the express consent of the consumer, who has been informed before the provision that under the provision of the entrepreneur will lose the right to resign from the contract;
2) in which the price or remuneration depends on fluctuations at the financial market that the trader does not control, and which may occur before the deadline to resign from the agreement;
3) the object of which is to provide for the non-prefabricated, manufactured according to the specifications of the consumer or his maid meet individual needs;
4) the object of which is to provide for the rapid decay dispersible or having a short usage life;
5) in which the subject of the provision is the thing delivered in a sealed container, after the opening of the package can’t be returned due to health protection or hygiene reasons, if it were unsealed after delivery;
6) on the subject of which benefits are things that after delivery, due to their nature, are inextricably linked with other things;
7) which are subject to the provision of sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery;
8) for the supply of digital content which is not stored on a tangible medium if the performance has begun with the express consent of the consumer before the deadline to withdraw from the contract and after having informed him by a trader of the loss of the right of withdrawal.
(For Entrepreneur) In the case of closing the sales as a business / entrepreneur the right to resign from a distance contract within the framework of 14-day refund is not entitled. The Act of 30 May 2014. Consumer Rights Acts. U. of 24 June 2014. Pos. 827 enables resignation from a distance contract a consumer law, regulating the relations between a trader and a consumer, who is a natural person making the entrepreneur with legal action not directly related to its business or professional activity.
Complaint - The seller is obliged to deliver a new thing, unused and without flaws. We are liable under the warranty for physical and legal defects of the product to the extent specified in Article. 556 et seq of the Act of 23 April 1964 - Civil Code (Dz. U. of 2014, pos. 121). If you purchased the product with a defect, please fill out the claim form and send back the product with a claim form and proof of purchase. Please be advised that we do not accept complaints sent "cash on delivery". Product package can be replaced, but should in the same way as the original package protect the product from damage during shipment. The customer of the complaint would be asked to put the following information: name (name of company), mailing address, e-mail (e-mail), which wants to sent a response to the store to the complaint, the date purchase the product, the type of product being advertised, possibly an accurate description of the defect and the date of its statement, the Client's request, a way to inform about the way the complaint. Along with the application the complaint must provide proof of purchase of the goods in the form of a copy sales receipt or invoice, print from a bank account, print with a payment card or other proof. Seller corresponds to the warranty, if the physical defect is found within 12 months from the date of delivery of goods to the Client.
The seller is liable under the right of warranty for physical defects of the product that existed at the time of the transition danger to the Customer or resulting from causes in an item at the same time.
If a product has a defect, the Customer may submit a statement of the price reduction or resignation from the contract unless the Seller immediately replace the defective product free of defects or defect removal. This limitation does not apply if the product has already been replaced or repaired by the Seller or Seller did not satisfy the obligation to replace the product free of defects and defect removal. The customer can resign from the contract if the defect is irrelevant. Customer may also require replacement of things for free from defects or defect removal.
Seller may refuse to satisfy the request of the Buyer, if the damage removal or replacement:
a) is impossible or
b) compared to the second possible way to bring about compliance with the agreement, would require excessive costs.
c) the cost of replacement or repair exceeds the price of the thing sold- if the buyer is an entrepreneur.
The consumer can demand instead of proposed by the Seller removal of defects the new product free from defects or instead of a replacement request the removal of defects, unless it is impossible or would require excessive costs in comparison with the method proposed by the Seller. Within 14 days of receiving the Product we consider the Complaint (applies to Consumer). In the event that the Complaint product will be repaired or replaced with an identical free of defects within a reasonable time. In the case of an effective withdrawal, the refund will occur immediately. We also pay shipping costs paid by the customer. Shipping costs should also be justified economically is why we propose to use the services of the Polish Post. We do not accept COD parcels. In the case of non-recognition product complaint is sent to the customer unchanged. The client may appeal the decision adversely affecting him to the arbitration court of the consumer and to the court. Detailed consumer rights are established by law.
Personal data - information that are administered during order entry goal dispatch. The Act of 29 August 1997 on the Protection of Personal Data (Dz. U. of 1997., No. 133, item 883) sets out rules of processing personal data and the rights of individuals whose personal data are or may be processed in the collection of personal data . Personal data processed by the store owner in accordance with Article. 23, clause 1, item 3.4 and 5 of the Act of 29 August 1997 on the protection of personal data are processed only for the purposes of implementation of the mail-order sales. The shop owner guarantees the rights under the above mentioned Act, ie. allows access to their personal data and correct or delete the data. The collection of personal data is registered with the Inspector General.
Customer - a legal entity or individual who places an order through a catalog Ars Tattoo - enters into a contract of sale with the owner of the shop, and is the consumer in accordance with Article. 22 , the Civil Code and the entrepreneur subject to special regulations for wholesale customer. Clients can also be minors who are at least 13 years of age insofar as it may acquire rights and assume obligations in accordance with the provisions of applicable law (in particular Art. 14 § 2 of the Civil Code). Part of the provisions of the Regulations applies only to consumers that is directly determined.
Customer Registration - registration allows your data to be stored in the Client's database store and the history of their orders which affect the allocated discounts. During registration, the Customer is required to provide a unique password. Customer is responsible for not sharing their password to any third party and shall bear all the possible consequences of the financial and legal instruments for such sharing.
Login customer - a process in which the registered customer enters their email address and password previously established in the process of registration. Logged customer has an access to order status and order history.
Shopping Cart – Element from the store Ars Tattoo, where the customer carries the products which intends to purchase. The customer may at any time view the contents of their cart, add or remove products, and also go to the purchase process.
The process of buying - When the customer has completed the products in the cart they can go into the buying process which specifies the order details such as delivery address, billing information, delivery method, payment method, etc. It can also keep all entered personal information and purchase history by registering.
Newsletter - Cyclic electronic newsletter issued by the shop Ars Tattoo, where are published, among others, information about the offer and current promotions. The newsletter is sent only to customers who have expressed a desire to receive it. The customer can at any time unsubscribe from the newsletter.
In matters not covered in these below rules provisions of Polish law, especially the law of 23 April 1964 from the Civil Code (consolidated text. U.z 2014 pos. 121, as amended. Chg.) would be used. In the case of clients being customers the provisions of the Act of 30 April 2014. consumer rights (Dz. U. 2014., pos. 827) will be valid. The consumer as a customer store Ars Tattoo has the right to make use of extra-judicial complaint and redress consumer, which involve, among others on:
a) the right to ask the provincial inspector of Trade Inspection with a request to initiate mediation proceedings of a dispute between a consumer and shop Ars Tattoo,
b) the right to issue a request for permanent arbitration court of the consumer, who worked at the provincial inspectorate of Trade Inspection of the resolution of the dispute concerning the sale agreement.
The use of the above rights is voluntary and both consumer and Ars Tattoo shop should agree in order to apply this procedure.
The consumer is informed that the Rules of organization and operation of permanent consumer courts of arbitration determines the Regulation of the Minister of Justice dated 25 September 2001. On the rules of organization and operation of permanent consumer courts of arbitration (Journal of Laws 2001, No. 113, item. 1214) .
Consumer request to the appropriate field and the Regional Inspectorate of Trade Inspection may include a request for mediation, an application for examination of the case before the consumer arbitration. Institutions in their units and on their websites should provide application forms.
Detailed information about extrajudicial methods of complaint and redress as well as the rules of access to these procedures are made available to consumers’ headquarters and on the websites of district (municipal) consumer ombudsmen, social organizations to which statutory tasks include consumer protection, the Provincial Inspectorates of the Trade Inspection and at the following addresses Office of Competition and Consumer Protection:
The consumer in terms of cross-border dispute has the right to use the European Consumer Centers Network. The addresses of these institutions are available on the website of the European Consumer Centre www.konsument.gov.pl.
Annexes to the Regulations are the model resignation form, claim form.
Ars Tattoo Shop announces that it reserves the right to change these Terms and Conditions. The content of the amendments to the Rules customer store Ars Tattoo will be notified by placing on the website Ars Tattoo store information about changes in the Regulations, indicating the changes in the Regulations. The news of the amendments to the Regulations on the Shop website will be maintained for at least 14 calendar days.
Customers registered and having account in the store Ars Tattoo will also be notified of changes in the Regulations by sending on their e-mail address (e-mail), specified in the registration form, information on changes to the Regulations, no later than 14 calendar days prior to entry into force of amendments to the Regulations.
Amendments to the Regulations will come into force on the date specified, along with information about changes in the Regulations, but not earlier than after 14 calendar days from the date of notification of the amendment of the Rules on the website.
The revised Regulations will involve the customer, who has registered Client Account in the Online Store, if in the absence of acceptance of amendments to the Rules customer does not indicate within 14 calendar days of receiving information about changes in the Regulations on termination of service agreement account registration.
If you change these Terms and Conditions, all contracts, orders and reservations made before the date of entry into force of amendments to the Regulations, will be implemented in accordance with the Regulations on the date of the contract/ the order.
These Regulations shall enter into force on 25 December 2014 and applies to contracts concluded from that date.
